WRG attorney Diana McGraw will serve as faculty member and speaker for an upcoming Norfolk & Portsmouth Bar Association CLE on the Common Interest Doctrine and the pitfalls of joint defense agreements. Attendees will discuss the common interest doctrine and the current splits between Circuit Courts in Virginia. In analyzing common interest doctrine, you will review the following: (1) are the participants in litigation or do they reasonably anticipate litigation; (2) what degree of commonality of interest among the participants is required; and (3) who must participate in the communication. Attendees will also look at common interest doctrine from the federal perspective and recent decisions from the Fourth Circuit Court of Appeals.
